Kanadski imigracioni zakon je vrlo precizan, decidan i gotovo nemilosrdan kada us u pitanju dvije vrste prestupa, jedan je ozbiljno kriminalno djelo a drugi mirepresentation ili laganje na zahtjevu za useljenje u Kanadu.

Slavko Rogan je neprihvatljiv (inadmissible) za useljenje u Kanadu po obe sekcije imigracionog zahtjeva.

Naime, pod Zabranom o useljenju u Kanadu zbog Kriminalnog Akta,

sekcijom 35.(1)a osoba ne moze dobiti status u Kanadi ako je “osoba sa stalnim boravkom u Kanadi ili osoba koja je predala zahtjev za useljenje u Kanadu prekrsila ljudska prava ili medjunarodna prava sa pocinjenim djelom van Kanade koji pretstavlja kazneno djelo koje se odnosi na sekciju 4.,5.,6.,7. Zakona o Kriminalnim Djelima Protiv Ljudi – Humanosti te Ratne Zlocine    

Pod zabranom za useljenje u Kanadu pod mirepresentation – ili laganju na zahtjevu ili izostavljanju deklariranja svih osobnih informacija

sekcija 40(1)a kaze: Osoba sa stalnim boarvkom u Kanadi ili strani drzavljanin koji pokusava da udje u Kanadu je zabranjen ulazak i neprihvatljiv je za stalni boravak u Kanadi ako:

“sekcija 40(1)a – ako je direktno ili indirektno lazno prezentirao cinjenica na zahtjevu, nije naveo sve relevantne osobne informacije sto bi mogle dovesti do pogresne aplikacije Imigracionog Zakona,

Na osnovu informacija koje sam procitao o ovom zlocinuc, ukljucujuci cio sudski transkript za sada bih se suzdrzao od komentara ali bih svakako uradio nesto drugo a to je da ispred Kongresa te nasih zajednica u Hamiltonu i Torontu napisemo pismo Mr. Kenney-u, Minsitru za Imigraciju da koristi svoj autoritet u procesu odstranjivanja ove anomalije zvana Slavko Rogan a takodje da obavjestimo vlasti u BiH koje bi mogle traziti njegovu extradikciju u BiH da mu se lijepo ljudski sudi za zlodjela.

 INADMISABILITY

35. (1) Human or international rights violations — A permanent resident or a foreign national is inadmissible on grounds of violating human or international rights for

(a) committing an act outside Canada that constitutes an offence referred to in sections 4 to 7 of the Crimes Against Humanity and War Crimes Act;

(b) being a prescribed senior official in the service of a government that, in the opinion of the Minister, engages or has engaged in terrorism, systematic or gross human rights violations, or genocide, a war crime or a crime against humanity within the meaning of subsections 6(3) to (5) of the Crimes Against Humanity and War Crimes Act; or

(c) being a person, other than a permanent resident, whose entry into or stay in Canada is restricted pursuant to a decision, resolution or measure of an international organization of states or association of states, of which Canada is a member, that imposes sanctions on a country against which Canada has imposed or has agreed to impose sanctions in concert with that organization or association.

 

40. (1) Misrepresentation — A permanent resident or a foreign national is inadmissible for misrepresentation

(a) for directly or indirectly misrepresenting or witholding material facts relating to a relevant matter that induces or could induce an error in the administration of this Act;

(b) for being or having been sponsored by a person who is determined to be inadmissible for misrepresentation;

(c) on a final determination to vacate a decision to allow the claim for refugee protection by the permanent resident or the foreign national; or

(d) on ceasing to be a citizen under paragraph 10(1)(a) of the Citizenship Act, in the circumstances set out in subsection 10(2) of that Act.

(2) Application — The following provisions govern subsection (1):

(a) the permanent resident or the foreign national continues to be inadmissible for misrepresentation for a period of two years following, in the case of a determination outside Canada, a final determination of inadmissibility under subsection (1) or, in the case of a determination in Canada, the date the removal order is enforced; and

(b) paragraph (1)(b) does not apply unless the Minister is satisfied that the facts of the case justify the inadmissibility.

[Editor's Note: SOR/2002-227, s. 320(9) provides that a person is inadmissible under the new Immigration and Refugee Protection Act, S.C. 2001 c. 27 for misrepresentation if, on June 28, 2002, the person had been determined to be inadmissible on the basis of paragraph 27(1)(e) or (2)(g) or (i) of the former Immigration Act, R.S.C. 1985, c. I-2.]
